When is ESI Registration Mandatory?

The 10-employee rule catches more businesses than you would expect. We regularly onboard clients who have been operating at 12–15 employees for over a year, completely unaware that they crossed the threshold. The 15-day registration window started ticking from the day they crossed — not the day they called us. That gap becomes their backdated liability.

15-Day Deadline:

Once your establishment employs 10 or more eligible employees on any single day, you have 15 days to register with ESIC. Each new employee must be individually registered within 10 days of their joining date. Both deadlines are firm — ESIC calculates backdated contributions from the date of eligibility, not the date you file.

Tamil Nadu coverage:

The same ESI Act applies across all of Tamil Nadu — Coimbatore, Madurai, Tiruppur, Hosur, Salem. If your head office is in Chennai but workers are in other Tamil Nadu cities, they are covered under the same registration.

ESI Contribution Rates — FY 2025-26

One thing that surprises most new clients: the contribution rates were cut significantly in 2019. Employer rate dropped from 4.75% to 3.25%, employee rate dropped from 1.75% to 0.75%. We still see other consultants and even some CA firms quoting the old rates. If your current advisor is telling you the total is 6.5%, they are working from outdated information.

Criminal breach of trust

Deducting the 0.75% employee contribution from salary and not depositing it is a criminal offence under IPC Sections 406 and 409. This can be prosecuted independently by any affected employee — it does not require ESIC to file a complaint first.
