The reality: The 10-employee rule catches more businesses than you would expect. 15-Day Deadline: Once your establishment employs 10 or more eligible employees on any single day, you have 15 days to register with ESIC. Each new employee must be individually registered within 10 days of their joining date. Both deadlines are firm — ESIC calculates backdated contributions from the date of eligibility, not the date you file.

ESI Contribution Rates — FY 2025-26

One thing that surprises most new clients: the contribution rates were cut significantly in 2019. Employer rate dropped from 4.75% to 3.25%, employee rate dropped from 1.75% to 0.75%. Skipping Half-Yearly Returns

Not Applying the ₹176/Day Exemption Correctly

Daily-wage workers earning ₹176 or less per day are exempt from ESI. But this threshold applies to the actual daily rate, not a notional conversion of monthly salary. Using monthly ÷ 26 to get a daily figure and comparing to ₹176 is technically wrong and has led to incorrect exemption claims during ESIC inspections.
